These Terms of Service ("Terms") govern your use of Avocabo ("Avocabo", "we", "us", "our") and the daily newsletter digest, inbox processing, and related services we provide (the "Service"). By using Avocabo, you agree to these Terms.
The short version: we read the newsletters in your inbox so you don't have to. We never modify your inbox, the digest is for your personal reading, and the Service is provided as-is — we'll do our best to keep it useful and reliable, but we can't guarantee perfection.
1. What Avocabo Does
Avocabo is a daily email digest. We summarize the newsletters arriving in your inbox (or a dedicated forwarding address, if you prefer) and send you one curated email each morning. We are currently pre-launch and granting access in small batches via a waitlist.
2. Your Account
You do not need an account to join the waitlist. When the Service launches and you create an account:
- You are responsible for keeping your login credentials secure.
- You must provide accurate information when signing up.
- You may delete your account at any time.
We may suspend or terminate accounts that violate these Terms.
3. Inbox Access
If you connect a Gmail or Outlook inbox, you grant us read-only access to your messages via OAuth. We will not, under any circumstances:
- Delete, archive, label, or move messages in your inbox.
- Send messages from your account.
- Read messages that are not classified as newsletters by our filter.
You can revoke our access from your Google or Microsoft account at any time, and the Service will stop processing your inbox immediately.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to disrupt, overload, or interfere with the Service.
- Scrape or bulk-download content from the Service without our permission.
- Use automated tools to access the Service in a way that exceeds reasonable usage.
- Forward email to your Avocabo forwarding address on behalf of someone else without their consent.
5. Digest Content — Informational Only
The digests we send you summarize content written by third parties (the newsletter authors). We do our best to summarize accurately, but:
- Summaries are interpretations, not direct quotes. They may abridge, reorder, or paraphrase the original article.
- AI-generated content may contain errors. Our summarization uses a large language model, which can occasionally misrepresent the source.
- The opinions in summarized articles belong to their original authors. Inclusion in your digest does not mean we endorse them.
If a summary is materially misleading, please let us know so we can investigate.
6. Intellectual Property
All content on Avocabo that we author — including the marketing site, the digest design, the product code, and our own writing — is owned by us or our licensors and is protected by copyright and other intellectual property laws.
The content of the newsletters we summarize remains the intellectual property of the original authors and publishers. We summarize under fair use / fair dealing principles for the purpose of personal reading.
You may use the Service for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works from our content without our written permission.
7. Pricing and Payment
The waitlist is free. After launch, Avocabo will offer a free tier (limited number of newsletters per month) and paid tiers (Pro and Power). Pricing is shown on our pricing page and may change with notice.
If a paid tier is in effect, payment terms will be presented to you before any charge is made.
8. Availability and Changes
We aim to keep Avocabo available and reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. For material changes, we will give reasonable notice via email.
We may also update these Terms from time to time. When we do, we will update the date at the top. Continued use of the Service after changes means you accept the updated Terms.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
- We are not liable for any damages arising from your use of (or inability to use) the Service, including but not limited to decisions made based on the contents of a digest.
- Our total liability to you for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim (which, while we remain pre-launch, is zero).
10. Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the competent courts of Romania. If you are a consumer resident in another EU member state, nothing in this clause deprives you of the protection of mandatory consumer-law provisions of your country of residence.
